Anthem Blue Cross and Blue Shield* (the "Plan") has developed an online system enabling contracted health care providers to access a detailed medical and pharmacy claim history for current and former Plan members ("P360"). The information provided by this system is provided by the Plan for reference purposes only. The information DOES NOT include medical records, but only relates to medical, pharmacy, and facility claims that have been submitted to Anthem that have been made available through the P360 by Plan. The Plan does not warrant the accuracy of the information displayed, but rather the information is provided as it is maintained in our data warehouses. This means that the claims history information may not be complete. Claims that are in process or have not been loaded into the P360 are NOT included. Health care providers SHOULD NOT rely upon this information as if it were a part of a medical record when making treatment decisions. All treatment decisions, and the consequences and outcomes thereof, are the responsibility of the health care provider and the patient, not the Plan. The information provided by this system IS NOT an authorization for benefits for any treatment by the Plan or a waiver of any utilization management requirements that the health care provider or member are obligated to follow to avail themselves of the highest level of benefits. Coverage decisions are subject to all terms and conditions of the member's benefit plan, including specific exclusions and limitations, and to applicable state and/or federal law. The data provided by this system is Protected Health Information and must be treated in accordance with law, and in any event with the same degree of care you take with other Protected Health Information you use or disclose and as permitted under HIPAA and other applicable laws. IMPORTANT NOTE: You are not permitted to use or disclose Protected Health Information about individuals that you are not currently treating. This applies Protected Health Information accessible in any Anthem online tool, or sent in any other medium including mail, email, fax, or other electronic transmission. The P360 shall only be used by you for patients receiving treatment from you. Health care providers using the P360 must ensure that such information is subject to the provider's own privacy and security policies and procedures that require the protection of the information as Protected Health Information. You represent and warrant that you have adopted and maintain adequate privacy security policies and procedures that require your adherence to all applicable privacy and security laws and regulations. You agree to indemnify and hold harmless the Plan and its affiliates and their respective officers, directors, employees and agents from any loss, damages, or expenses arising out of violation by you or your employees and agents of the terms of this user agreement, including but not limited to the terms relating to individual privacy rights. By accepting this Agreement, you are hereby agreeing to its applicable terms on behalf of yourself and all authorized providers and locations operating under your Tax ID Number. This Agreement is valid for one year and must be accepted on an annual basis, unless there are changes to the Agreement required by law which require acceptance prior to that date.
